Terms of Use

These Terms of Use (the “Terms”) govern your use of Ten2Whale, including the website at ten2whale.com and the Ten2Whale mobile application (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Ten2Whale is a game in which players trade simulated positions on historical stock market charts. All balances, trades, loans and results are virtual, have no monetary value and cannot be exchanged for money or anything of value. The Service is not a brokerage, does not execute real trades and does not provide investment, financial, tax or legal advice. Past market data shown in the Service is provided for entertainment and education only, may contain errors, and is provided as is.

2. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian.

3. Your account

You are responsible for your account and for keeping your password confidential. Provide a valid email address and do not create accounts to manipulate leaderboards. You may delete your account at any time under Settings → Delete account, as described in the Privacy Policy.

4. Community rules: zero tolerance for objectionable content and abusive users

Your username is shown to other players on leaderboards, player profiles and in battles. We have zero tolerance for objectionable content and abusive behavior. You agree not to:

choose a username that is hateful, harassing, threatening, sexually explicit, profane, discriminatory, or that impersonates another person, Ten2Whale or its staff;
harass, bully, threaten or abuse other players;
cheat, exploit bugs, automate play, or otherwise manipulate game results or leaderboards;
interfere with the Service, its servers or other players’ use of it.

Every player profile has a Report button and a Block button. Blocking a player hides them from your leaderboards. We review reports within 24 hours and act on content that breaks these rules, which may include renaming a username, removing results, and suspending or permanently removing the account responsible.

5. Intellectual property

The Service, including its software, design, text and graphics, is owned by Ten2Whale and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. Market data and company names belong to their respective owners.

6. The App Store

If you downloaded the app from Apple’s App Store, these Terms are between you and Ten2Whale, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is a third-party beneficiary of these Terms entitled to enforce them against you. Your use of the app must also comply with Apple’s Licensed Application End User License Agreement.

7. Suspension and termination

We may suspend or end your access to the Service if you break these Terms or if needed to protect the Service or other players. You may stop using the Service and delete your account at any time.

8. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free, or that any data in it is accurate. To the fullest extent permitted by law, Ten2Whale is not liable for any indirect, incidental or consequential damages, or for any decision you make based on the Service. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.

9. Changes

We may update these Terms. When we do, we will change the effective date above. Continuing to use the Service after a change means you accept the updated Terms.
